Former Gov. Mitt Romney, who maintains homes in New Hampshire and California, voted in the Bay State’s special Republican primary in December using his son’s Belmont mailing address.

Romney, who sold his Belmont manse last year, listed his son Tagg’s address to vote in the GOP primary in the race for late U.S. Sen. Edward M. Kennedy’s seat. Romney has also already mailed in a ballot to vote in the Jan. 19 special election between GOP state Sen. Scott Brown and Attorney General Martha Coakley.

Romney spokesman Eric Fehrnstrom said, “Since selling his home, Gov. Romney has maintained his residence in Massachusetts while he looks for a new place to live. He has made an offer on a condo in Belmont and expects to close in March.”

Brian McNiff, spokesman for Massachusetts Secretary of State William Galvin, said Romney is free to declare any residency he chooses and that it could only be invalidated through a formal complaint.

“That can be challenged at the polls,” McNiff said. “The residency is not cut and dried, if that’s where he says he lives.”

Romney’s special election vote was first reported by online political site Talking Points Memo.
