Sen. John McCain (R-AZ) announced today that he will vote against Sonia Sotomayor, Pres. Obama's nominee to become the first Hispanic SCOTUS justice.
McCain, in a Senate floor speech:
Again and again, Judge Sotomayor seeks to amend the law to fit the circumstances of the case, thereby substituting herself in the role of a legislator. Our Constitution is very clear in its delineation and disbursement of power. It solely tasks the Congress with creating law. It also clearly defines the appropriate role of the courts to "extend to all Cases in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties." To protect the equal, but separate roles of all three branches of government, I cannot support activist judges that seek to legislate from the bench. I have not supported such nominees in the past, and I cannot support such a nominee to the highest court in the land.
McCain voted against Sotomayor's nomination to the 2nd Circuit Court of Appeals in '98, so his decision is not entirely surprising. But like his friend and GOP colleague, Sen. Lindsey Graham (SC), McCain has decried the politicization of judicial nominations that led to a failed Dem filibuster of Justice Samuel Alito. Graham, citing a desire to "start over" on the Senate's advise and consent role, was the only GOP member of the Senate Judiciary Cmte to support Sotomayor's nomination last week.
McCain is also seeking re-election in '10. While he coasted to re-election in '04, he won AZ in last fall's presidential race by just single digits.
More than 30% of AZ's population is Hispanic, according to the latest Census estimates, and exit-poll data shows McCain won only 41% of the Hispanic vote last fall in his home state. According to that data, Hispanics made up roughly 16% of the '08 electorate in the state.

Not in the least surprised. He has said a zillion times that he would choose a true constructionist. Justice Sotomayor had major trouble the "the tag"!!!
I wonder if she also has trouble with the tag of being called a "woman"! Who knows? She has never really said anything favorable towards women. Being in a community group for mutual endorsement is one thing.. but taking a public stance in favor of women.. now that might irk 49% of the population -- ya think? I wonder what she's thinking.
Anyway, I'd rather she be fair and just, be true constructionist.

Her appointment was a oh so transparent grab at votes by Obama. He had trouble getting the women's votes and the latino votes both groups largely for Hillary and both pissed off at Obama. So he chooses a latino woman whether she is a good judge or not. All her decisions have been over turned. This helps no one. Especially not women but, a lot of people will point to this and say "See, he likes latinos and women!" yes, as long as they don't run for president against him with more experience than he has he just loves em...especially when he can use them for vote pandering.
I like that McCain stood by his word. She's not a very good judge and someone else would have been a better choice.
Interesting political play by McCain. Why find his Republican backbone over this confirmation? He also interviewed recently stating that he still thinks Sarah Palin would make a great President and that he doesn't think we have seen the last of her yet. Too bad it has taken him this long to defend HIS choice for VP.

On the side topic here.. McCain did support Palin early; he he did anymore 'standing up for' Palin, I would have said 'enough already, she can take care of herself.' He needed to give her space and he did. Right now, she is a bit vulnerable to media attack and he is being supportive. I like that.

WASHINGTON (AP) -- President Barack Obama is lauding the barrier-breaking confirmation of Sonia Sotomayor to be the first Hispanic justice on the Supreme Court.
Said the president: "With this historic vote, the Senate has affirmed that Justice Sotomayor has the intellect, the temperament, the history, the integrity and the independence of mind to ably serve on our nation's highest court."
Sotomayor will be sworn in on Saturday and appear with Obama at the White House on Wednesday.
Obama spoke moments after the Senate confirmed Sotomayor on Thursday.
The president called the occasion a wonderful moment for Sotomayor's family - and for America.
She replaces retiring Justice David Souter, who has retired.

As for McCain, I guess I had been disappointed in his sparce support of Sarah, but maybe it was for a reason. Perhaps he and Sarah thought it would be more damaging if they were viewed as "together" on issues instead of her own standing?
